Welcome to Spinel Gem Therapy. These Terms of Service ("Terms") govern your access to and use of spinelgemtherapy.com (the "Site") and your purchase of any products from us. By using the Site or placing an order, you agree to be bound by these Terms.

Spinel Gem Therapy is a Canadian retailer of natural, handpicked spinel gemstones and other fine gems, based in Markham, Ontario, Canada.

2. Eligibility

By placing an order, you confirm that you are at least 18 years old (or the age of majority in your province or state of residence), legally capable of entering a binding contract, and using the Site for personal, non-commercial purposes unless otherwise agreed in writing.

3. Products & Descriptions

Each gemstone listed on our Site is a unique natural specimen. We make every effort to display accurate photographs, weights, dimensions, and descriptions. However, please note:

  • Color, clarity, and appearance can vary based on lighting, monitor calibration, and viewing angle
  • Natural inclusions, surface features, and minor variations are characteristic of genuine gemstones and not defects
  • Where treatments (such as heat treatment) have been applied, this is disclosed in the product listing

If a stone you receive differs materially from its description, contact us under our Refund Policy.

4. Pricing & Availability

All prices are listed in the currency shown at checkout and are subject to change without notice. Because each gemstone is one-of-a-kind, listings are removed once a stone is sold. We reserve the right to correct pricing errors and to refuse or cancel any order placed at an incorrect price, with a full refund.

5. Orders & Payment

By placing an order, you make an offer to purchase. We reserve the right to accept or decline any order at our discretion. We accept the payment methods listed at checkout. Payments are processed securely through Shopify's PCI-DSS compliant systems and we do not store full payment card details.

6. Shipping

Shipping terms, processing times, transit estimates, and customs responsibilities are described in our Shipping Policy, which is incorporated into these Terms by reference.

7. Returns & Refunds

Our return and refund process is set out in our Refund Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

All content on the Site — including photographs, text, logos, designs, and other materials — is owned by or licensed to Spinel Gem Therapy and is protected by Canadian and international copyright and trademark laws. You may not copy, reproduce, distribute, or use any of our content for commercial purposes without our written permission.

9. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or to violate any law in your jurisdiction
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems

Our products are sold as natural gemstones. Any references on the Site to spiritual, healing, or therapeutic associations of specific stones reflect traditional beliefs and customer interest in those traditions. They are not medical claims. We do not promise any specific physical, emotional, or spiritual outcome from purchasing or using a gemstone, and our products are not a substitute for professional medical advice, diagnosis, or treatment.

11. Limitation of Liability

To the maximum extent permitted by law, Spinel Gem Therapy and its owners, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim arising under these Terms is limited to the amount you paid for the product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold Spinel Gem Therapy harmless from any claim or demand, including reasonable legal fees, made by a third party arising from your breach of these Terms or your violation of any law or third-party right.

13. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page with the effective date at the top. Material changes will take effect 30 days after they are posted, unless an earlier effective date is required by law.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of or relating to these Terms or the Site.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
